Seller Terms: MakerFoundry
Effective date: November 2, 2026
These Seller Terms add to MakerFoundry's Terms of Service for makers who publish designs, and for those who sell them. If they differ, these Seller Terms apply to publishing and selling. "We" is Bruce Wattendorf, doing business as SiteSentrix; "you" is the maker.
1. Publishing designs
Before you publish a design, you confirm that:
- you have the rights: you made it, or you have written permission from whoever did to share or sell it under the licence you choose;
- it's your own work: it doesn't copy another design, and doesn't use logos, brands, characters or artwork that belong to someone else (sports teams, cartoon characters, company logos, other designers' work), unless you have their written permission;
- the files work as the listing says, in the formats listed, and you've stitched or cut it yourself;
- the photos are yours, of results made from this design;
- the listing is honest: its title, description, sizes and licence describe the design.
We read each file to check it and draw its preview. We may refuse, unpublish or remove a design that breaks these terms or the Terms of Service, and we close the accounts of makers who repeatedly infringe others' rights (Terms § 9).
2. Who may sell
Anyone with a MakerFoundry account may sell. To sell, you connect a Stripe Express account. Stripe checks who you are and pays you; MakerFoundry never sees or keeps your bank details. You must be 18 or older and able to accept Stripe's terms (stripe.com/connect-account/legal), which apply between you and Stripe.
3. Prices
You set each paid design's price in US dollars, from $1.00 to $200. You can change it at any time; a change doesn't affect sales already made.
4. Our fee
For each sale, MakerFoundry keeps a platform fee of 10% of the price. The card fee (2.9% of the price + $0.30) also comes out of your share. Each is rounded to the nearest cent, and you receive the rest: for a $5.00 design, our fee is $0.50, the card fee $0.45, and you receive $4.05. Each sale on your sales page shows the price, our fee, the card fee and what you receive.
We may change our fee with at least 30 days' notice by email; changes never apply to sales already made.
5. Taxes
Sales tax. Paid sales aren't open on MakerFoundry yet: for now every design is shared free. Before they open, we'll add here how sales tax is handled, and these terms will ask for your agreement again before you can sell.
Income tax. You are responsible for tax on what you earn. Stripe may send you, and the IRS, a Form 1099-K where the law requires.
6. Getting paid
Stripe pays your earnings once a month (on the 1st, for the sales that have cleared by then) to the bank account you gave Stripe. We may ask Stripe to hold payouts while a refund, dispute or suspected fraud is being resolved.
7. Refunds and disputes
Because designs are delivered at once, sales are final, except: if a file is broken, or isn't what your listing described, the buyer may ask for a refund within 30 days. We'll ask you first, and you may fix the file instead. If we refund the buyer, our fee is refunded to you, but the card fee isn't, because Stripe keeps it: for a $5.00 design, $4.50 comes out of your earnings (the $4.05 you received plus the $0.45 card fee).
If a buyer disputes a payment with their bank (a chargeback), Stripe takes the amount and its dispute fee from your earnings. We'll help you answer it with the sale's records.
8. What buyers get
Each buyer gets the licence you chose for the design (Terms § 3) and may download the files they bought again at any time while their account is open, even if you later unpublish the design or stop selling. They may not share, sell or give away the files themselves.
9. Our permission to show and deliver your designs
You keep ownership of your designs, files and photos. You give us the permission in the Terms of Service (§ 4) to store them, make previews, show them and deliver them to buyers and downloaders. Unless you turn it off for a design, that includes delivering an embroidery design converted to the other embroidery formats MakerFoundry writes, made from your file when someone downloads it, under the same licence and price. For designs already sold, that permission continues so that buyers keep their files.
10. Leaving
You can unpublish designs and stop selling at any time. Money already earned is paid out as usual, less any refunds or disputes still open. If we close your account for breaking these terms, we may hold payouts for up to 90 days to cover refunds and disputes, then pay what's left.
11. The rest
Everything else (disclaimers, limits of liability, indemnity, changes, Rhode Island law, contact) is as in the Terms of Service. Contact: support@makerfoundry.app.
